TERMS AND CONDITIONS

Last Updated: June 30, 2026

1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of services provided by Hunter Digital Solutions ("we," "us," "our"), including website design, automation setup, CRM configuration, missed-call text-back systems, and related digital services. By engaging our services, you ("client," "you") agree to these Terms.

2. Services Provided

We provide website design, landing pages, automated lead follow-up systems, missed-call text-back systems, AI chatbots, CRM setup, appointment booking systems, and email/SMS marketing services to small and local businesses. Specific deliverables for each engagement will be outlined in a separate scope of work or proposal.

3. Payment Terms

Services are billed as either (a) a one-time setup fee, and/or (b) a recurring monthly retainer for ongoing service and maintenance. Monthly retainers are billed on a recurring basis and continue until cancelled in accordance with Section 4. Payment is due as specified in your individual service agreement or invoice.

4. Cancellation

Clients may cancel a monthly subscription/retainer at any time by contacting us directly via email or phone. We request 30 days' written notice prior to cancellation to allow for an orderly transition. No refunds will be issued for the current billing period upon cancellation unless otherwise agreed in writing.

5. SMS/Text Messaging Communications

As part of our services, we may send SMS text messages on behalf of you or your business, including automated missed-call replies, appointment reminders, and marketing/promotional messages, under the messaging program "Hunter Digital Solutions." Message and data rates may apply. Recipients may opt out of text messages at any time by replying "STOP" to any message received.

6. Intellectual Property

All content, branding, trademarks, logos, and visual designs created or owned by Hunter Digital Solutions remain our exclusive property unless explicitly transferred in writing. Custom deliverables created specifically for a client (e.g., a website built for that client) become the property of the client upon full payment, unless otherwise agreed.

7. Client Feedback

If you provide us with feedback, suggestions, or ideas regarding our services, you agree that we may use, implement, and incorporate this feedback into our services without compensation or attribution to you.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you to Hunter Digital Solutions for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

9. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith informal negotiation. If the dispute cannot be resolved informally within a reasonable period, the parties agree to resolve the dispute through binding arbitration rather than in court.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
